Release Agreement Upheld
Jamieson v. Whistler Mountain Resort 2017 BCSC 1001
Dr. Jamieson was a mountain biker who suffered serious injuries while biking in a park owned by the defendant Whistler Mountain. Prior to using the park, Dr. Jamieson had signed a release agreement waiving any legal recourse for any wrongdoing done by Whistler Mountain in connection with use of the bike park. Dr. Jamieson sued Whistler Mountain for injuries but the court gave effect to the release agreement and dismissed his case on that basis.
This case is similar to Gordon v Krieg (see our website under Cases) and is a cautionary tale for consumers to be mindful of any release documents they are asked to sign as they may affect one's legal rights on a loss.
